Security Guards/Armed Security Guards



Private security guard” in Delaware shall mean an individual employed by a private security agency to perform one or more of the following functions: prevention of intrusion, entry, larceny, vandalism, abuse, fire, or trespass on private property. Unarmed Security Guards are issued and hold a “Yellow Card.”

Private Security Agencies and Private Security Guards are licensed through the Delaware State Police Professional Licensing Section and regulated by the Board of Examiners of Private Security.

Fingerprinting and Applications for Security Guards is conducted by the State Bureau of Identification.

Armed” shall mean any private security guard in Delaware who carries or has immediate access to a firearm in the performance of his or her duties. Armed Security Guards in Delaware receive a firearms endorsement to their unarmed security guard license. Unarmed Security Guards are issued and hold a “Yellow Card.” Armed Security Guards are issued an additional “Red Card” which is an endorsement to their Unarmed/Yellow Card License.

What is the process to obtain or renew an Unarmed Security Guard License (Yellow Card) in Delaware?

1. Individuals shall successfully complete a mandatory Security Guard training program. This training program must be completed through Delaware Technical & Community College (DTCC) OR the security agency which employs the individual.

2. Individuals who satisfactorily complete the mandatory training program will take the mandatory state security license Test/Exam. A passing grade of 75% must be obtained. 3. Individuals must call the State Bureau of Identification (SBI) at (302)-739-2528 for an appointment. On the appointment day, individuals will come into one of our two (2) locations (Delaware State Police Troop 2/Newark or Dover) for fingerprint and picture processing. 4. Individuals must complete an employee application, see the link below. Applications are also available at both State Bureau of Identification (SBI) locations (Delaware State Police Troop2/Newark or Dover SBI office).

5. At the time of their appointment with the State Bureau of Identification (SBI), individuals will be fingerprinted and photographed. Individuals must turn in their mandatory Training Certificate and Test/Exam Certificate to SBI. Individuals coming to an appointment should bring four (4) specific items:
• Photo Identification (Driver License or State Identification)
• $85.00 fee
• Your Mandatory Security License Training Certificate provided by your certified trainer.
• Your Security License Test/Exam Certificate provided by Delaware Technical & Community College (DTCC).

6. Upon approval and submission of mandatory training program and test certificates, License Identification cards will be mailed to the address listed on the individual’s application. If requested, the individual may return to the Dover State Bureau of Identification (SBI) location only to retrieve their License Identification card in person. Security Licenses (new or renewed) are valid for five (5) years.

Fees, if any, for taking the course through an agency are determined and applied at their discretion. What does a Private Security Agency and Private Security Guard mean?

“Private security agency” shall mean any person engaging in the business of or undertaking to provide a private watchperson, guard or street patrol service on a contractual basis for another person and performing any 1 or more of the following or similar functions:
a. Prevention of intrusion, entry, larceny, vandalism, abuse, fire, or trespass on private property;
b. Prevention, observation or detection of any unauthorized activity on private property;
c. Control, regulation or direction of the flow or movements of the public, whether by vehicle or otherwise, only to extent and for the time directly and specifically required to assure the protection of property; or
d. Supervises event security staff.

“Private security guard” shall mean an individual employed by a private security agency to perform one or more duties as described under the definition of a private security agency.


What types of security or other personnel are not required to be licensed in Delaware?
Persons hired and employed directly by a business entity or person, commonly referred to as “in-house” security, etc. are not required to be licensed. For Example: ABC Department Store employs persons directly to be Security or Loss Prevention.

What criminal charges or other circumstances would disqualify me from getting a security license?

§1314. Security guard registration requirements.
Anyone who wishes to be licensed, under this chapter, as a noncommissioned security guard, must meet and maintain the following requirements:

1. Must be at least 18 years of age;

2. Must not have been convicted of any felony;

3. Must not have been convicted of any misdemeanor involving a theft-related offense, drug offense, or moral turpitude, within the last 7 years, and:

a. There are no more than 2 of such misdemeanors during such person’s lifetime; and

b. No misdemeanor conviction occurred during or as a result of employment in a capacity regulated by this chapter.

4. Must not have been, as a juvenile, adjudicated delinquent for conduct which, if committed by an adult would constitute a felony, unless and until that person has reached his or her twenty-first birthday;

5. If served in the armed forces, must not have been dishonorably discharged;

6. Must not be a member or employee of any law-enforcement organization, as defined by the Council of Police Training;

7. Must meet and maintain the qualifications set and approved by the Board of Examiners.


How do I fulfill the Training Requirement to become a security guard?

You must take a Mandatory Security Guard training program with an approved instructor. There are two (2) options…
1.This training program can be completed through Delaware Technical & Community College (DTCC). To take the Security Guard training program through DTCC, contact their Workforce Development Office. https://www.dtcc.edu/about/contact-us

2.The security agency which employs the individual. To take the Security Guard training program through a private security agency contact the individual agency and inquire if they have a certified instructor(s) to provide the training.

Upon successful completion of the training course the individual will be provided with a Training Certificate from the certified class instructor.


How do I take the Test/Exam required to become an Unarmed Security Guard?

Upon completion of the Security Guard training program through DTCC or an individual private security agency instructor, you are then required to take a security guard test/exam through Delaware Technical and Community College (DTCC). The test/exam is administered exclusively at DTCC. The fee is $49.00. You must present your training program certificate and have valid/photo ID for admittance to the test.

Upon successfully passing the Security Guard test/exam (75% score) individuals will be provided with a Security Guard Test/Exam Certificate from DTCC.

An individual who fails to obtain a 75% or higher on the test/exam is permitted to re-test on a separate date and pay the $49.00 fee for each subsequent attempt.

After taking my Security License Training how long do I have to take my Security License Test/Exam?

You will need to take the Test within one year of the date of your training certificate.


What is a passing score for the Security License Test/Exam and how can I re-take if failed?

You will need to score a 75% or better to successfully pass the Security Exam at DTCC. If you fail, the test can be re-taken however a re-testing fee of $49.00 will apply each time. There is no limit on how many times the test/exam may be attempted within one year of your training. The training class would not need to be repeated within one year, only the test/exam.


How do I make an appointment to apply for my security license?

What four (4) items do I need to bring to my fingerprinting/security license application appointment?

How long is my Unarmed (Yellow Card) Security License valid and when does it expire?

Your security license is valid for five (5) years. Your license expires on your actual birthdate. Your security license can be used for employment at any private security company licensed in Delaware.


How long does the process take between getting fingerprinted and receiving my security license?

If you request to pick up your license it would normally be available in 3-5 business days at the Dover SBI office location only. If your license is mailed it depends on the postal service delivery and you should allow at least ten (10) business days after the license is approved. Individual factors regarding your background may cause the process to take longer.


How can I check on the status of my Security license after 10 business days?

Every effort is made to process licenses in a timely manner. If it has been more than ten (10) business days since the date of your application/fingerprints being submitted and you have not been advised of an issue, you may contact Professional Licensing.

What does “non-refundable” mean regarding my Security License Application?

Your Application fee will NOT be returned if
• Your Application is rejected due to disqualifying charges or conditions
• You submit an application containing omissions or statements which are not true and correct
• You fail to respond and/or supply any request from Professional Licensing for additional information or documentation specifically requested about your application within thirty (30) days. Your application will also be destroyed at that time.


What happens if I am denied my Security License?

A certified letter will be sent to the address on the individual’s application by Professional Licensing. The letter will give you instructions for your next steps.


My Security License has been processed and approved but I do not have the License Identification Card in my possession. Am I still permitted to work as a Licensed Security Guard without the License Identification Card?

No, you must always be in physical possession of your Security License Identification Card while performing security guard duties. Delaware State Police Professional Licensing may conduct unannounced site inspections at any time.


Do I need to be employed by a Private Security Agency to receive the training, take the test/exam, apply or possess at Security Guard License?

No, but you must indicate “Not employed by an Agency” on your application. Your options for training still include receiving it through Delaware Technical Community College or a Security Agency that provides training.

Once employed by a Private Security Agency it will be the agency’s responsibility to account for you on a mandatory monthly roster submitted to Professional Licensing.


If I am not currently employed by a Private Security Agency, am I permitted to work or act as a security guard?

Under no circumstances is a licensed security guard permitted to work or act unless he/she is employed by a Licensed Private Security Guard Agency and working at a location under their control or contract.


If I have a license in another state am I able to work in Delaware?

No, you must apply for a Delaware Security License. Delaware does not have reciprocity with any other states.


When am I required to carry (physically possess) my Security License and other certification cards?

At all times while performing security guard duties. If you have an Armed Red/Card endorsement you must carry that Red Card as well. If you are certified to carry a Baton, Inflammatory Agent Spray, Chemical Spray and/or Handcuffs you must carry your training credentials for these items. Delaware State Police Professional Licensing may conduct unannounced site inspections at any time.


What is the process to renew my current Unarmed (Yellow Card) Security License?

The process to renew your security license is the same as the process to initially obtain your security license. Your security license is valid for five (5) years. Considering you must re-train and re-test, we recommend starting the renewal process at least two (2) months before your expiration date.


Am I allowed to work if my Security License is expired?

No, you must have a valid security guard license on your person while performing security guard duties.


What is a summary of all costs/fees associated with obtaining and renewing my Security License?

• Security License Training – Cost/Fee, if any, is determined by where you receive your training.
• Security Exam Fee – $49.00. Re-testing fee of $49.00 applies for each attempt at passing.
• Security License Application Fee for Unarmed/Yellow Card – $85.00. If you are applying for both your Unarmed/Yellow Card and Armed/Red Card endorsement at the same time, there is no extra charge for the Armed/Red Card endorsement. If you apply for the Firearms/Red Card endorsement at a later date, a $30.00 fee will be applied.

Cost/Fee, for some or all, of these items may or may not be covered by Private Security Agencies who employ you. Please inquire with the company for individual policies.

• The Board approves security guards (Unarmed & Armed) registered in 24 Del.C. Ch. 13 to carry law enforcement style batons, inflammatory agent sprays, chemical sprays and handcuffs.
• The carrying of these weapons/items is only authorized after the security guard completes the appropriate training program with a certified instructor as required by the manufacture of the weapon/item. It is the responsibility of the guard’s employer to ensure this training is completed and the proper training certification is issued.
• It shall be the security guard’s and the security agency responsibility to maintain certification and requalification with the weapon/item consistent with manufacturer standards.
• Please note while Delaware regulations may permit all outlined items, individual security agencies will decide if their security guards may carry such items.


What if I am arrested or found in violation of any disqualifying charges while holding my Security License?

You must notify the Professional Licensing Section within five (5) business days, excluding weekends and holidays. Failure to report may result in the suspension or revocation of a license.


What if my valid security license is lost or stolen?

Come into one of our two (2) SBI locations (DSP Troop 2/Newark or Dover SBI office) and request a replacement. No appointment is necessary. Valid License holders fill out the application for the replacement (the link for the form is on the front page or there are copies at SBI). A license must be valid to be replaced. What role does Professional Licensing, the State Bureau of Identification and the Board of Examiners play in obtaining an Unarmed (Yellow Card) Security License and an Armed (Red Card) License?

Professional Licensing is a section of the Delaware State Police assigned to regulate several occupations including Private Security Agencies and Guards. This includes conducting background investigations and records checks of both. Professional Licensing is the investigative and operational arm of the Board of Examiners of Private Security Agencies.

The State Bureau of Identification/Front Desk is assigned to process individuals applying to be Security Guards. This includes obtaining identification information, fingerprints, and photographs of applicants.

The Board of Examiners for Private Security Agencies determines and promulgates the qualifications and regulations for security guards in Delaware. The Board is responsible to investigate alleged violations of state law regarding security guards. Upon review the Board may deny, suspend or revoke security licenses as necessary and hear appeals of the same.

All firearms endorsements for armed security guards are valid for a period of one year. Private security agencies must provide the Professional Licensing Section with documentation that employees (Armed Guards) are compliant with firearm certification and recertification requirements by January 15th of each year for the previous calendar year.

What is a Firearms Endorsement?

Firearms endorsements (Red Card) are issued to individuals who already hold or approved to hold an Unarmed Security Guard License (Yellow Card) and wish to be firearms certified. To maintain an Armed (Red Card) endorsement the guard’s Unarmed License (Yellow Card) must remain valid. Both the Unarmed (Yellow Card) and the Armed (Red Card) may be applied for at the same time for an $85.00 fee. If the Unarmed (Yellow Card) holder returns at a later application date there will be an additional $30.00 fee.


What criminal charges or other circumstances would disqualify me from getting a firearms endorsement?

Regardless you are reminded, The Gun Control Act (GCA), codified at 18 U.S.C. § 922(g), makes it unlawful for certain categories of persons to ship, transport, receive, or possess firearms or ammunition, to include any person:

• Convicted in any court of a crime punishable by imprisonment for a term exceeding one year;
• Who is a fugitive from justice;
• Who is an unlawful user of or addicted to any controlled substance (as defined in section 102 of the Controlled Substances Act, codified at 21 U.S.C. § 802);
• Who has been adjudicated as a mental defective or has been committed to any mental institution;
• Who is an illegal alien;
• Who has been discharged from the Armed Forces under dishonorable conditions;
• Who has renounced his or her United States citizenship;
• Who is subject to a court order restraining the person from harassing, stalking, or threatening an intimate partner or child of the intimate partner;
• Who has been convicted of a misdemeanor crime of domestic violence.

As an Armed Security Guard what are some legal matters I should be aware of?

Armed (Red Card) Security Guards…
• Are not permitted to carry a concealed deadly weapon unless they have been issued a concealed deadly weapons permit. Your Security Firearms/Red Card is not a concealed carry permit.
• Are only permitted to carry their firearm in the performance of duties as a security officer or traveling directly to or from a place of assignment.
• Must wear firearms in plain view.
• Must wear a distinctive uniform indicating they are a security guard. The uniform must display a distinctive company patch.
• Are not permitted to carry any type of weapon not approved by the Board and trained by a board-approved instructor.

During the first calendar year of my initial training and qualification what other training documents do I need to provide to Professional Licensing?

The initial qualification course and shoot sheet shall be used to fulfill one day and one low light requirement during the first year; however, an additional day shoot must be completed at least 90 days after the date of initial certification, within the calendar year.


What do I need to do after my initial qualification calendar year to stay qualified?

To open carry a firearm while in the performance of their duties and maintain their qualification, individuals licensed to carry a firearm under 24 Del.C. Ch. 13 must:
• Shoot a minimum of three (3) qualifying shoots per calendar year, scheduled on at least two (2) separate days, with a minimum 90 days between scheduled day shoots. Of these three (3), there will be one mandatory “low light” shoot which may be combined with a day shoot. Two (2) day shoots shall not be completed on the same date.
• These qualifying shoots will be administered by an approved firearms instructor. Firearm/Red Cards expire every year on December 31st, Firearm Guards must have all annual training requirements (shoots) completed prior to October 1st and submitted to Professional Licensing no later than December 31st.

• The carrying of these weapons/items is only authorized after the security guard completes the appropriate training program with a certified instructor as required by the manufacture of the weapon/item. It is the responsibility of the guard’s employer to ensure this training is completed and the proper training certification is issued.
• It shall be the security guard’s and the security agency responsibility to maintain certification and requalification with the weapon/item consistent with manufacturer standards.
• Please note while Delaware regulations may permit all outlined items, individual security agencies will decide if their security guards may carry such items.

The Board of Examiners of Private Investigators and Private Security Agencies, the regulatory body for this industry, meets on a quarterly basis. New licensure and renewals with changes of an agency must be approved by the Board of Examiners.
