Troopers Arrest Suspect for Assault on Law Enforcement Officers-Smyrna

Smyrna– The Delaware State Police have arrested a Smyrna man after a traffic stop led to an assault on two Law Enforcement Officers.

The incident occurred on Wednesday, August 8, 2018 at approximately 8:25 p.m., when  members of the of the Kent County Governor’s Task Force conducted a traffic stop on a white Honda Accord that was traveling northbound on Dupont Parkway (SR 13), south of Smyrna Landing Road.  It was known to Troopers, that the driver, identified as 38-year-old James Mayer had an active warrant in reference to a drug investigation.

As Troopers attempted to place Mayer into custody, he began to resist.  The Trooper deployed his TASER at which time Mayer was able to be detained.  During the struggle with Mayer, two Troopers sustained minor injuries.  One Trooper responded to the Bayhealth Kent General Hospital where he was treated and released.  The second Trooper declined medical treatment.

During this incident Mayer was found to be in possession of 54.67 grams of crack cocaine and 17 Oxycodone pills. Mayer was transported back to Troop 3 where he was charged with the following:

  • Possession of  a controlled substance in a Tier 5 quantity
  •  Manufactures, delivers, or possesses with intent to deliver a controlled
    substance in a Tier 4 quantity
  •  Assault 2nd injure a Law Enforcement Officer (2 counts)
  •  Resisting Arrest
  • Possession of a Controlled or Counterfeit Substance
  • Possession of Drug Paraphernalia

Mayer was arraigned before the Justice of the Peace Court 11, for his active warrant on drug related charges and current charges.  He was committed to the Sussex Correctional Institution on $120,000.oo secured bond.
