Date Posted: Sunday, March 2nd, 2025

News Release

Delaware State Police arrested 41-year-old Jessica Smith of Townsend, Delaware, on Saturday morning following a welfare check at Wawa in Middletown.

On March 1, 2025, at approximately 7:30 a.m., troopers were dispatched to Wawa, located at 2398 Dupont Parkway, after a concerned citizen reported seeing a white female driving a Dodge Charger who appeared to be under the influence, with a child in the backseat.

When the troopers arrived, they located a Dodge Charger matching the vehicle’s description. The driver, later identified as Jessica Smith, attempted to back out of the parking space but was stopped by troopers. When they contacted Smith, they smelled a strong odor of marijuana coming from the vehicle and observed signs of impairment.

Further investigation revealed that Smith was impaired. A subsequent search of the vehicle revealed approximately 20.28 grams of marijuana, 5.97 grams of crack cocaine, 8.29 grams of powder cocaine, 14 MDMA pills (commonly known as ecstasy), 6 Oxycodone pills, drug paraphernalia, and approximately $710 in suspected drug proceeds. Troopers also saw that an unrestrained child, later determined to be a relative of Smith, was in the back seat. Smith was taken into custody without incident, and the child was safely turned over to a family member.

Smith was then transported to Troop 9, where Standardized Field Sobriety Tests revealed additional signs of impairment. A legal blood draw for DUI was conducted, and she was subsequently charged with the below-listed offenses, arraigned by Justice of the Peace Court 11, and released after posting a $9000 secured bond.
