Domestic Incident Led to Shots Fired- Rehoboth Beach

Rehoboth Beach– The Delaware State Police have arrested two suspects after an altercation led to the discharge of a weapon.

The incident occurred on Thursday, August 2, 2018 at approximately 11:10 a.m., when police were dispatched to the 37000 of Johnson Street, for a report of a domestic incident.  Upon arrival, Troopers located a 19-year-old male victim with injuries.

It was learned that the 19-year-old victim was visiting his mother’s residence on Johnson Street, when his sister, 21 year-old Delilah Boyernd of Harrington, and her boyfriend 21-year-old Marvin Burton of Rehoboth Beach showed up at the residence.  Marvin exited the vehicle and began confronting the 19-year-old, which led to a physical altercation.  Marvin proceeded to go back to the vehicle he arrived in, at which time Delilah who was still in the driver’s seat, placed the vehicle in drive and accelerated towards her brother’s direction, missing him along with her other 22-year-old and 15-year-old brothers.   However, Delilah struck a tree, causing the front windshield and passenger window to shatter.  Delilah exited the vehicle and was screaming and yelling.  Marvin then obtained a handgun from the glove box and a struggle between him and the 19-year-old ensued.  Marvin struck the 19-year-old in the head with the handgun. While the two struggled over the gun, the weapon was discharged and the 19-year-old was able to take possession of the magazine.  In the meantime, Delilah’s 50-year-old mother had exited her residence, at which time Delilah and she engaged in a physical altercation.  Marvin and Delilah eventually proceeded back to the vehicle and fled the scene.

Troopers located the vehicle, a silver Kia Sol, along with the sole occupant, Delilah, in the subdivision of Aspen Meadows off of Munchy Branch Road, Rehoboth Beach.  A short time later, Troopers located Marvin at his residence in the 35000 block of E. Atlantic Circle, where he was taken into custody without incident.

The 19-year-old male victim was transported by ambulance to a local area hospital where he was treated and released.  The 22-year-old and 15-year-old male victims were not injured.  The 50-year-old victim sustained minor injuries and declined medical treatment.

Located at the scene was a magazine for a .40 caliber handgun loaded with bullets.  A search warrant was later executed on Marvin’s residence, which led to the discovery of .40 caliber ammunition and a leather holster.

Marvin and Delilah were transported back to Troop 7.

Marvin Burton was charged with the following:

  • Possession of a Firearm During the Commission of a Felony
  • Possession of a Firearm or Ammunition By a Person Prohibited (2 counts)
  •  Assault Second Degree
  • Reckless Endanger First Degree
  • Conspiracy 2nd

Marvin was arraigned before the Justice of the Peace Court 2 and committed to the Sussex Correctional Institution on $100,000.00 cash only bond. 

Delilah Boyer was charged with the following:

  • Possession of a Deadly Weapon During the Commission of a Felony (3 counts)
  • Aggravated Menacing (3 counts)
  • Conspiracy 2nd
  • Assault 3rd Degree

Delilah was arraigned before the Justice of the Peace Court 2 and committed to the Delores J. Baylor Women’s Correctional Institution on $80,000 secured bond.
