Newark- Delaware State Police arrested 38-year-old Robert Brown of Fredericksburg, VA, and 31-year-old Thomas Smith of Woodbridge, VA, on weapon and drug charges following a traffic stop on Wednesday afternoon.

On March 3, 2021, at approximately 3:45 p.m., a trooper working patrol on Interstate 95, Newark, observed a black Toyota Camry commit a traffic violation in the area of Route 72. The trooper conducted a traffic stop and made contact with two subjects inside of the vehicle, later identified as Robert Brown and Thomas Smith. Upon contact the trooper smelled an odor of marijuana emitting from inside the vehicle and an investigation ensued. A probable cause search was conducted, and the trooper discovered a loaded Glock 29 10mm handgun, approximately 31.98 grams of marijuana, and over $1,200 is suspected drug proceeds.

Brown and Smith were taken into custody without incident and transported to Troop 2 where they were charged with the following crimes:

Brown

• Possession of a Firearm During the Commission of a Felony (Felony)
• Possession of a Firearm by Person Prohibited (Felony) – 2 counts
• Carrying a Concealed Deadly Weapon (Felony)
• Possession of a Weapon by Person Prohibited and Controlled Substance (Felony)
• Possession of Marijuana
• Failure to Signal

Brown was arraigned in the Justice of the Peace Court and released on $27,550 unsecured bond.

Smith

• Possession of a Firearm During the Commission of a Felony (Felony)
• Possession of a Firearm by Person Prohibited (Felony) – 2 counts
• Carrying a Concealed Deadly Weapon (Felony)
• Possession of a Weapon by Person Prohibited and Controlled Substance (Felony)
• Possession of Marijuana

Smith was arraigned in the Justice of the Peace Court and released on $24,500 unsecured bond.
