Troopers Arrest Milford Man on Multiple Drug and Weapon Charges-Harrington

Harrington- The Delaware State Police have arrested 23-year-old Brian W. Holben after he was found to be driving under the influence and in possession of a weapon and drugs.

The incident occurred on February 2, 2020 at approximately 5:42 p.m., when Troopers were dispatched to the area of Beebe Road and Woodyard Road, Harrington, for a maroon Ford F-150 blocking the roadway.  Upon arrival, Holben was located in the driver’s seat of the F-150 and appeared to be confused and disoriented.  A DUI investigation ensued.  A computer inquiry revealed that Holben’s license was suspended and that he was a person prohibited from possessing a weapon or ammunition. It was also discovered that the truck was unregistered and the registration had been altered. Holben was taken into custody without incident.

A search of the vehicle was conducted and the following was located:

  •  A Remington 870 12G Shotgun
  • Shotgun ammunition
  • Approximately 10.99 grams of marijuana
  • Approximately 10.19 grams cocaine
  • Drug paraphernalia

Holben was transported back to Troop 3 where he was charged with the following:

  • Possession of a Firearm During the Commission of a Felony
  • Possession of a Firearm Within 10 Years of Prior Conviction of Any Felony
  • Possession of a Firearm or Ammunition by a Person Prohibited Prior Violent Crime or Felony
  • Possession With Intent to Deliver Controlled Substance
  • Possession of Destructive Weapon
  • Driving a Vehicle Under the Influence of Drugs
  • Alter or Falsify Registration Card
  • Possession of Drug Paraphernalia
  • Driving While Suspended
  • Failure to Have Insurance Identification
  • Expired Tags
  • Failure to Have Registration Card in Possession
  • Operation of an Unregistered Motor Vehicle
  • Possession of Marijuana
  • No person shall stop, stand, or park where obstruct free passage of traffic

Holben was arraigned before the Justice of the Peace Court and committed to the Sussex Correctional Institution on $62700.00 secured bond.
