Traffic Stop Leads To Felony DUI, Drug, and Weapon Charges- Smyrna

Smyrna- The Delaware State Police arrested 39-year-old Brandon Evans of Smyrna, DE, on 3rd Offense DUI after a traffic stop which also led to the discovery of drugs and a handgun.

The incident occurred on November 29, 2020, at approximately 12:04 a.m., when a Trooper observed a white 2010 Chevrolet Impala traveling eastbound on Big Oak Road above the posted speed limit. A traffic stop was initiated, and contact was made with the driver, Brandon Evans when a strong odor of alcoholic beverages was detected. A DUI investigation ensued, and Evans was asked to step out of the vehicle. A pat down search was performed on Evans and the trooper located a loaded .25 caliber handgun in Evan’s pants pocket.

Also discovered inside of Evans vehicle was approximately 2.2 grams of marijuana.

Evans was taken into custody without incident and transported back to Troop 9 where he was charged with the following:

  • Carrying a Concealed Deadly Weapon, A Firearm (Felony)
  • Possession of a Firearm By Person Prohibited (Felony)
  • Possession of a Firearm if Previously Convicted (Felony)
  • 3rd Offense Driving Under the Influence
  • Possession of Marijuana
  • Speeding

Evans was arraigned before the Justice of the Peace Court #7 and committed to the Howard R. Young Correction Institution on $26,200.00 cash bond.
