Dover Man Arrested on Felony Weapon, Drug, and Traffic Charges after Single Vehicle Collision- Middletown

Middletown- The Delaware State Police arrested 24-year-old Capice Johnson of Dover, DE, on felony weapon, drug, and traffic charges after he was involved in a single-vehicle collision.

On July 7, 2020, at approximately 8:33 p.m., troopers responded to a single-vehicle collision on the Korean Memorial Highway (SR 1) at the Biddle Toll Plaza, Middletown. Before arriving on the scene, Johnson’s white Kia Optima with Delaware registration was reported by another individual traveling northbound on SR 1 with no headlights illuminated and unable to maintain a lane of travel. Upon arrival to the scene, troopers discovered Johnson’s vehicle was the same. Through the trooper’s investigation, it was determined Johnson was traveling towards the cash tolls when it struck the concrete barrier separating two toll lanes.

Contact was made with a cash collector from the Toll Plaza, who witnessed the collision. The witness reported after the crash; Johnson removed a black sweatshirt that was located under the front passenger seat and exited the vehicle. Johnson then placed the item in the vehicle’s trunk area before getting back in the car and sitting back down in the driver seat.

During the investigation of the crash, a strong odor of marijuana was detected from inside the vehicle and emanating from Johnson’s person. Investigating measures determined Johnson was driving under the influence of drugs.

A search of Johnson’s vehicle incident to arrest revealed inside the black sweatshirt in the trunk was a Taurus 9mm handgun. On Johnson’s person, a bag of marijuana weighing approximately 27.22 grams was located inside his pants

Johnson was taken into custody and transported to Troop 9 where he was charged with the following crimes:

  • Possession of a Firearm During the Commission of a Felony (felony)
  • Possession of a Firearm After Convicted of a Felony (felony)
  • Receiving a Stolen Firearm (felony)
  • Possession of Marijuana Other Than Personal Use Quantity (27.22 grams)
  • Driving a Vehicle Under the Influence of Drug
  • Failure to Have Insurance Identification in Possession
  • Failed to Remain within a Single Lane

A computer check revealed the firearm in Johnson’s possession was reported stolen by Dover Police Department, Dover, on May 15, 2020.

Johnson refused medical attention on the scene but was later transported from Troop 9 to a nearby hospital for a laceration to his head.

Johnson was arraigned in Justice of the Peace Court and was committed to Howard R. Young Correctional Institution on a $24,000.00 secured bond.
