Man Jailed on Felony Offense DUI

Millsboro
– The Delaware State Police have arrested a 42-year-old Millsboro
man after he was found asleep at the wheel of his tan Ford Windstar
while being under the influence of alcohol.
Troopers were
dispatched to the area of Phillips Branch Road and Hollymount Road
yesterday at approximately 7:41 pm after a passerby called 911
reporting they observed a subject “passed out” at the wheel of the
Windstar.
When troopers
arrived, they contacted the operator, Charles H. Irwin III,
and observed that he was exhibiting indicators he may be under the
influence of alcohol. A DUI investigation ensued in which Irwin
failed field sobriety tests. Additional investigation revealed
Irwin’s driver’s license was revoked and he had prior convictions
for DUI in 1986, 1989, 1994 and 2001.
He was taken
into custody without incident. Troopers then transported him to
Beebe hospital for a legal blood draw to obtain evidence of his
blood alcohol concentration. While at the hospital, Irwin became
verbally disorderly with the trooper and the hospital staff and
yelled numerous profanities towards them creating a risk of public
inconvenience.
Afterward he
was taken to Troop 7 in Lewes where he refused to be fingerprinted
and processed for his arrest. As a result of the investigation,
Irwin was charged with 4th Offense DUI, Failing to Comply with
Taking of Photo and Fingerprints, Driving while Suspended or
Revoked, Disorderly Conduct, and 3 additional traffic offenses. He
was remanded to the Sussex Correctional Institute in lieu of a
$7800.00 secured bond.
