Released-
Monday, May 12, 2008
Bear /
Newark- On Friday, May 9th,
Troopers were called to the Center Point Plaza on Churchmans Road in
reference to a terroristic threatening complaint.
Officers
arrived on the scene and contacted the 44-year-old victim. The
victim advised he collects wooden pallets no longer being used by
area businesses and sells them for about $2.00 per unit. He said
that on Monday May 5th, he was collecting pallets from
Governors Square Shopping Center when he was confronted by a male
subject, later identified as Floyd J. Henry, 71, of Newark.
Mr. Henry
allegedly took issue with the fact that the victim was infringing on
his business by taking pallets from his self-proclaimed route.
Apparently, these pallets are offered to whom ever wants them on a
first come, first serve bases, from certain businesses. Henry began
to yell at the victim and threatened to kill him. Henry walked over
to the victim’s truck and began to take a pallet from the back when
the victim intervened. Henry then threw a pallet at the victim
causing a minor injury. Henry and the victim then both left the
scene.
On May the 9th,
the victim again found himself face to face with Floyd Henry. This
time it was at Center Point Plaza. The victim was lawfully loading
pallets into the rear of his truck when Henry again pulled up behind
him. Henry got out of his truck and began yelling profanity at the
victim. The victim, wanting to avoid another confrontation, began
to walk away at which time Henry threw an unknown liquid on the
victim’s back. Henry again tried to take a pallet from the victim’s
truck. This incident was witnessed by several area business
employees.
Warrants were
completed for Henry’s arrest. He was apprehended by a Wilmington
Police Officer on Sunday, May 11th. Henry was formally
charged with the following misdemeanors: Offensive Touching, Assault
3rd, two counts of Menacing, two counts of Disorderly
Conduct, two counts of Terroristic Threatening and two counts of
Attempted Theft. He was arraigned and released on a $3,750.00
unsecured bond and ordered to have no contact with the victim.
