DSP News Release: December 17, 2009, 9:17 am, Burglary Suspects Apprehended while attempting to flee the scene
Location: Birch Street, Lewes, DE
Date of Occurrence: 12/15/2009, at approximately 4:00 am
Defendants:
Resume: In the early morning of 12/15/09, Troopers from Troop 7 responded to a possible burglary in progress on Birch Street, Lewes, DE. A concerned neighbor heard strange noises coming from their neighbor’s home and contacted the police. Prior to the troopers’ arrival on the scene they observed a suspicious vehicle fleeing the area of the home. Troopers conducted a traffic stop on the suspicious vehicle, which was occupied by the three defendants.
Short time later troopers were able to confirm that the three defendants in the vehicle had unlawfully entered the home on Birch Street and removed items. Troopers were also able to confirm that no one was home at the Birch Street residence during the time of the incident. Troopers then placed the three defendants in custody without incident.
Benjamin Steward was charged with Burglary 2nd (f), Theft (f), Conspiracy 2nd (f), and Criminal Mischief (m). Benjamin Steward was arraigned on his charges he received $5,500 unsecured bail and released pending trial.
Frank Miller was charged with Burglary 2nd (f), Theft (f), Conspiracy 2nd (f), and Criminal Mischief (m). Frank Miller was also arraigned on his charges received $5,500 unsecured bail and released pending trial.
Emilee Kerrigan was charged with Burglary 2nd (f), Theft (f), Conspiracy 2nd (f), and Criminal Mischief (m). Due to Emilee Kerrigan being a juvenile her charges were transferred to Family Court, and she was released to her parents pending trial.
