Charges and Arraignment Information:

 

-Burglary 1st Degree

-Wearing a Disguise during the Commission of a Felony

-Unlawful Imprisonment 2nd Degree

-Assault 3rd Degree

-Malicious Interference with Emergency Communications

 

Arraigned at the Sussex County Court of Common Pleas and committed to the Sussex Correctional Institution for lack of $14,500 secured bail.

Seaford, DE- Delaware State Police detectives have arrested a 50 year old Magnolia, DE man in connection with a home invasion and assault that occurred in January of 2011.

 

After a nine month investigation, David S. Benson was arrested on Tuesday, October 11, and charged with the above list of crimes. He was arraigned at the Sussex County Court of Common Pleas and then committed to the Sussex Correctional Institution for lack of $14,500.00 secured bail.

 

The incident occurred on January 20, 2011 after a male suspect entered a residence located on Dogwood Drive in Seaford and proceeded to assault a 59 year old female victim as she slept. The victim was eventually able to flee from the residence and call 9-1-1 from a neighbor’s house. After a lengthy investigation, detectives were able to link Benson to the incident through physical evidence that was collected from the scene.

DSP News Release:  State Police Probe Seaford Home Invasion

  • Small frame individual, unknown sex or race, wearing dark clothing and a mask

 

Resume:

Seaford-Delaware State Police early Thursday January 20, 2011 investigated a home invasion on Dogwood Drive in the Nanticoke Acres development Seaford Delaware. 

 

Delaware State Police received a 911 call around 3:12 a.m. from the victim.  State Police detectives discovered the suspect entered the residence through a rear door. 

 

The victim was asleep at the time of the burglary and woke to the suspect striking her in the face multiple times.  The victim and suspect struggled as the suspect attempted to restrain the victim.  The victim during the struggle also attempted to 911 with her cellular phone however the suspect knocked it out of her hand.

The victim and suspect fell off the bed onto the floor at which time the victim was able to flee the residence to seek help.

 

The victim sustained facial lacerations as a result of the assault.  The victim could only describe the suspect being small in stature, wearing dark clothing and a mask.
